This Privacy Policy (“Policy”) describes the personal data collected by or on behalf of Cowboy Concepts LLC d/b/a Drop Cowboy (“Drop Cowboy”, “we”, “us”, or “our”) and its vendors through this website (“Site”), your use of our messaging and communications platform (“Platform”), and our other interactions with you, and how that data is used and shared. Privacy Policy Changes

This Privacy Policy is subject to change. We encourage you to review this Privacy Policy frequently for any revisions or amendments. If we make any material changes to this Privacy Policy, the revised policy will be posted on the Sites with the date of last update. Changes will be effective immediately upon posting. You will be deemed to have been made aware of and have accepted the changes by your continued use of our Sites or Services. Personal Information.

We may collect information that personally identifies, relates to, describes, or is capable of being associated with you (“Personal Information”), including:

Personal identifiers and contact information such as your name, email address, phone number, username and password, and other social media identifiers (e.g., Twitter handle, Instagram name, etc.);

Internet or other electronic network activity information such as your browsing history, search history, IP address, and information regarding your interactions with us (including interacting with us online, by the mobile application, and through advertisements);

Personal Information is required to use certain Site features, for example, to request information online, contact us via email, phone, or our Contact Us form (where we may retain your message’s content and our response), and to respond to communications from us. Personal Information is also required to establish an account on our Platform to access our services. The specific Personal Information we collect about you may vary based on how you use the Site and/or Platform and your relationship with us.

Marketing Communications; Opt Out. If you opt in to receive marketing communications from us, you will need to submit your name and email. We use this data to send you promotional and other electronic communications. If you provide us your cell phone number and provide you express consent, we will also use your cell phone number to send you marketing texts using automated dialing systems. If you opt-in to marketing communications the number of messages (whether via email or text) may vary per month. We may use third-party providers to deliver communications to you. You may opt out of such emails by using the unsubscribe link in the email or contacting us at info@dropcowboy.com with “Unsubscribe” in the subject line or by reply [STOP] to any text message that you receive from us. We may send you a confirming message via email or text to confirm that you have been unsubscribed. Your provider’s message and data rates apply to all texts that you may send to or receive from us. Opting out of marketing communications does not opt you out of communications related to transactions that you enter into with us and related transactional communications.

HOW WE COLLECT INFORMATION

Voluntary Disclosure

We may ask you to provide us with Personal Information when you communicate with us (online or offline), use the Sites or Platform, enter into a relationship with us, and at other times. You may also disclose Personal Information when you engage with the Sites or Platform such as when you sign up for an event or when you make or respond to communications on the Sites or Platform.

You are not required to provide us your Personal Information; however, if you choose not to provide the requested information, you may not be able to use some or all of the features of the Sites or Platform or we may not be able to fulfill your requested interaction.

We may collect Personal Information from third-party data sources such as marketing/advertising agencies and publicly available information. This information may be combined with Personal Information.

Generally

We do not sell or rent Personal Information except as stated in this Policy and as permitted by applicable law. Beyond the uses and sharing described above, Drop Cowboy and its vendors may use and share Personal Information as described below:

Services fulfillment and customer support: such as to keep users informed about the status of the Sites and Services, respond to questions and address user concerns, and deliver updates, upgrades, and product improvement information;

De-Identified Data

We may de-identify or anonymize Personal Information so that it is no longer capable of being associated with you and therefore is no longer Personal Information. We may use and disclose de-identified or anonymized information without restriction subject to applicable laws. We will not attempt to re-identify the individuals associated with previously de-identified or anonymized information.

Affiliates. We maintain a number of website affiliate arrangements and referral sources, which require us to share Personal Information back to the affiliate or referral source for purposes of paying commissions and verifying other activity related to the website affiliate or referral relationship. In addition, Drop Cowboy has a number of corporate affiliates, including parents, subsidiaries and sister companies, many of which may provide goods and services for which we think you may be interested. We may share your Personal Information among our corporate affiliates for purposes of providing support and other services to Drop Cowboy and to allow those corporate affiliates to send you marketing and other information to the extent permitted by applicable law.

Data Security

We use commercially reasonable technical and organizational measures to help secure all Personal Information against loss, misuse, and alteration. While we cannot guarantee it, we use industry-standard protections to help safeguard against such occurrences. If a breach of our systems occurs, we will notify you of the breach only if and as required under applicable law.

YOU UNDERSTAND THAT NO DATA TRANSMISSION OVER THE INTERNET OR A MOBILE DEVICE CAN BE GUARANTEED TO BE 100% SECURE. WHILE WE STRIVE TO PROTECT YOUR PERSONAL INFORMATION, WE DO NOT GUARANTEE THE SECURITY OF PERSONAL INFORMATION AND YOU PROVIDE PERSONAL INFORMATION AT YOUR OWN RISK.

Children’s Privacy

The Sites and Services are not intended for children under the age of 18 and we do not knowingly collect Personal Information from children under the age of 18. If we become aware that we have inadvertently received Personal Information from a child under the age of 18, we will delete such information from our records.

California “Shine the Light” Law

California Civil Code Section 1798.83, known as the “Shine The Light” law, allows California residents to opt-out of having their personal information shared with third parties for direct marketing purposes. To exercise your rights under this law, please submit a request to opt-out of sales and sharing using the methods described above.

Access from Outside the United States

This Site is operated and maintained by Drop Cowboy from the United States and is intended solely for a United States audience. If you access the Site from outside the United States, please be aware that Personal Information will be transferred to, stored in, and processed in the United States. U.S. data protection and related laws may not be as comprehensive as those from where you access the Site.

Third-Party Sites

The Site may link to, or be linked to, websites not controlled by us. We are not responsible for third- parties’ privacy policies or practices. This Policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.

Compliance with Laws and Law Enforcement

We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Information, Usage Data, and any other information about you to government or law enforcement officials or private parties if, in our sole discretion, we believe it is necessary or appropriate to respond to legal requests (including court orders, investigative demands, and subpoenas), to protect the safety, property, or rights of ourselves, consumers, or any other third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with law.

Other Transfers

How Long We Retain Your Data

California “Do Not Track” Disclosure

“Do Not Track” is a web browser privacy preference that causes the web browser to broadcast a signal to websites requesting that a user’s activity not be tracked. Currently, our Sites and Services do not respond to “Do Not Track” signals.
